Employer using a calculator to calculate ASOS

Member A is participating in an ASOS from 20/04/2023 to 30/06/2023.

During the ASOS, the member doesn’t fulfil their contractual responsibilities , and the employer agrees to pay 50% of the member’s normal salary for the days they participated in the action.

The member’s Full-time Salary is £62,154.

The monthly pensionable pay during the ASOS is calculated by the employer as follows:

April: 19 days at full pay (£3,280.35) and 11 days at 50% pay (£949.58) = £4,229.93

May: 31 days at 50% pay = £2,589.75

June: 30 days at 50% pay = £2,589.75

Note: The above calculations are an example only and it would be up to the individual employer to determine the pensionable pay for each month based on the agreed pay rate and ASOS period.

Month 1

For the April service submission, the following calculation would be performed to determine the days excluded to report on the April service line

  • Total Calendar Days in ASOS period: 30
  • Total Pensionable Pay during ASOS period: £4,229.93
  • Full-time Salary: £62,154
  • Previously Report Day Excluded: 0

Day Excluded: 30 – {[365 x (4229.93 ÷ 62154.00)] = 24.84 rounded up to 25} - 0 = 5

Month 2

For the May service submission, the following calculation would be performed to determine the days excluded to report on the May service line

  • Total Calendar Days in ASOS period: 30 +31 = 61
  • Total Pensionable Pay during ASOS period: £4,229.93 + £2,589.75 = £6,819.68
  • Full-time Salary: £62,154
  • Previously Report Day Excluded: 5

Day Excluded: 61 – {[365 x (6819.68 ÷ 62154.00)] = 40.05 rounded down to 40} - 5 = 16

Month 3

For the June service submission, the following calculation would be performed to determine the days excluded to report on the June service line

  • Total Calendar Days in ASOS period: 61 +30 = 91
  • Total Pensionable Pay during ASOS period: £6.819.68 + £2,589.75b = £9,409.43
  • Full-time Salary: £62,154
  • Previously Report Day Excluded: 5 + 16 = 21

Day Excluded: 91 – {[365 x (9409.43 ÷ 62154.00)] = 55.26 rounded down to 55} - 21 = 15

The calculated day(s) excluded must be reported in each service period the ASOS action was taken, and can’t be reported as a single total at the end of the ASOS period.

For part-time members, you’re required to record the actual part-time salary paid and the full-time equivalent. This means that the loss of pay due to strike action is reflected in the part-time earnings. For part-time service that requires days excluded to be supplied (MDC Concurrent Service), you need to provide the results of a revised calculation (using our Concurrent Calculator) with the reduced part-time earning included.
